Fluoride/Contaminated Water - National Legislation - 2005-2006

Representative Ken Calvert was involved in the 2000 Congressional Hearings on Fluoride . In 2005, he was a co-sponsor of a bill that would exempt water systems from liabilites surrounding contamination of drinking water. It is called the Drinking Water Standards Preservation Act (HR 1540)

HB 142 This bill modifies statewide and local initiative requirements and other ballot measures initiated by citizen petition by requiring fiscal impact estimates and by authorizing the repeal or amendment of laws when final estimated costs exceed initial cost estimates by a certain amount. Status

It appears this legislation will require all initatives that include a cost be accurate within 15%...except fluoride initatives.

Legislation 2004 Water Quality, Water and Irrigation

The following bills were specific to the fluoride question and the use of taxpayer funds to promote it.

HB 181 This bill modifies provisions governing the addition of fluorine to local water systems by requiring cost estimates and by authorizing citizens to revoke approval for the addition of fluorine when actual estimated costs exceed the cost estimates by a certain amount.

The bill was tabled in the Senate. Status

HB 324 This bill modifies provisions related to the addition of fluorine or any of its derivatives or compounds to water supplies. This bill requires preapproval from the legislative body, special district board, or board of directors of a water system consisting of less than 5,000 connections before fluorine or any of its derivatives or compounds can be added to the system. Status

The Health Department aggressively lobbied against this bill.

SB 85 This bill modifies provisions of the Political Activities of Public Entities Act. This bill: clarifies the definition of "public entity" and "public official"; and provides that public officials who violate the act are guilty of a class B misdemeanor. Status

The following bills were specific to the fluoride question

HB 64 This act modifies the Safe Drinking Water Act by allowing voters in a county,municipality, or water district the option to vote to add fluorine to or to cease adding fluorine to the public water supply. Status

HB 227 This act modifies the Safe Drinking Water Act to require that any substance added to a public water supply for the purpose of preventing or treating a disease be approved by the United States Food and Drug Administration. The act prohibits the addition of any product to a public water supply containing a contaminant regulated by the United States
Environmental Protection Agency, which at maximum use levels exceeds the EPA's Maximum Contaminant Level Goals.Status

HB 42 This act modifies the Safe Drinking Water Act to allow a public water system to supply fluoridated water to a county or municipality that has not approved fluoridation under emergency circumstances.Status

HB 43 This act modifies the Safe Drinking Water Act to allow a fluoridated water system to supply water to a resident in an adjacent municipality or county which has not approved fluoridation upon the request of a resident. Status

HB 309 This act modifies the Safe Drinking Water Act. The act defines a functionally separate water system. The act allows voters in a county, municipality, or water district the option to vote to add fluoride to or remove fluoride from the public water supply. The act makes technical
corrections. Status
